Vodafone content services terms and conditions

Section A: General


1. About these terms

a. These terms form a contract between you and us.

b. We recommend that you print off and keep a copy of these terms.

c. References to ‘us’ or ‘we’ mean Vodafone Limited registered at Vodafone House, The Connection, Newbury, Berkshire, RG14 2FN under registration number 01471587 and registered VAT number GB 569 95 32 78.

d. We may change or withdraw content services at any time and will change these terms and conditions from time to time. If any change would have a significant effect on you we will give you 30 days where reasonably possible. So you should check these terms and conditions each time you use our content services.

e. We may need someone else to meet some or all of our obligations under these terms on our behalf. You agree that we can transfer our rights and responsibilities under these terms to another Vodafone company.


2. Other people’s rights

All copyright, trademarks, patents and other rights in any material or content (including, but not limited to, software, information, applications, information, text, photographs, music, sound, videos, graphics, logos, symbols, artwork and other material or moving images) available through our content services is either owned by us or has been licensed to us by the owner. Nothing in these terms entitles you to any right to or interest over any of the content you get access to through the Vodafone network.


3. Liability

a. We are not responsible in any way for the content you get access to.

b. We will try to make sure that the information included in the content services is accurate at the time we include it. However, we are not liable for any loss or damage that you may suffer as a result of you getting access to any content service.

c. We provide the content services through a variety of telecommunications systems and we cannot guarantee that the systems will not have faults. You are responsible for checking that your mobile or other device you use is compatible with our content services. We will not be held responsible for any loss or damage you suffer in connection with you using the content services.

d. If we are liable for anything, that liability is limited to us refunding the price (if any) you paid for the content services.


4. Length of the contract

a. You agree that any cancellation rights you have under the Consumer Protection (Distance Selling) Regulations 2000, or other laws which may apply to supplying content services, will end as soon as we start to provide the content services to you.

b. We may suspend or change any or all content services immediately, and without giving notice, for any reason (including for repair or maintenance work).

c. We can end the contract immediately if you break any of these terms and conditions, or after giving you at least 30 days’ notice in writing in all other circumstances. You can end the contract immediately by contacting us. However, you will still have to meet any obligation you have to continue making payments under a fixed-term agreement.

d. If you subscribe to any Vodafone-content service as part of your tariff, your fixed-term agreement will apply and you can only end the content service in line with your price plan. If you pay a monthly subscription for any Vodafone content service, you can end that content service immediately by contacting us.

e. If you change your mobile number these terms and conditions will end.

f. When these terms end you will no longer be entitled to the content services we provide. However, Vodafone shall not be required to remove any software or other application in connection with any content service from your mobile, PC or other device and/or enable you to remove the same.


5. Legal

a.These terms and conditions are governed by the laws of England and Wales.

b. Nothing in these terms affects your legal rights as a consumer.

c. No person other than you has the right to benefit under or to enforce any of these terms.

d. We may send you notices by email, text, post or through our website.

Section B: Vodafone content


1. What we are providing

a. By Vodafone content we mean:

  • any information, applications, graphics, images, software, audio material and visual material we provide (or any other company provides on our behalf) for you to access, whether or not you download it; and
  • any content services we provide in connection with that material.

b. If you are abroad, we will try to give you access to Vodafone content services, but this will depend on where you are, and you may have to pay extra charges.


2. Access to Vodafone content

a. To get access to Vodafone content, you must be older than any minimum age that applies. If you are not old enough then you must not download content.

b. We give you the right to view and use the Vodafone content we provide for your personal use only. You cannot transfer that right.

c. You must not do the following with the downloadable content.

  • Use it for commercial purposes
  • Pass it on to other people or give anyone else access to it, unless they have permission from the copyright holder
  • Change, edit, copy, reformat or adapt it in any way
  • Use it in any way that we think is inappropriate, offensive or unacceptable.

3. How much you pay, and how to pay

a. The price of Vodafone content is the price advertised at the time you buy it. We can change prices from time to time.

b. If you pay us by calling a premium-rate line, or the charges are added to your Vodafone bill, you can only use the content services if you are the person responsible for paying the bill or the person paying the bill had agreed to the payment being made that way.

c. You must pay the full price of Vodafone content when we ask you to. If you don’t, we can immediately end your access to the Vodafone content.
