Survey Free Treat Offer (20 November 2017 to 31 March 2018)

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials for the Vodafone Survey Free Treat (the “Offer”). Participants of the Offer agree to these terms and conditions.

Who are we? The Promoter: Vodafone Limited, Vodafone House, The Connection, Newbury, Berkshire RG14 2FN.
Administrator: TLC Marketing UK Ltd, 17a-19 Harcourt Street, London, W1H 4HF.

  1. Eligibility: The Offer is open to selected customers who have completed one of Vodafone’s surveys and who are opted into Marketing Communications from Vodafone. The surveys will have been sent via SMS during the Promotional Period. The offer is limited to one per customer every 6 months.
  2. Promotional Period: 20 November 2017 to 31 March 2018. To redeem the offer, eligible customers must redeem their e-Gift within the specified deadline given in the SMS. Once the e-Gift has been redeemed, customers will have 24 hours to go in-store and spend it.
  3. How to participate:
    1. Eligible Vodafone customers will be contacted by Vodafone via SMS. This message will contain details of their Offer and a link to access their e-Gift; and
    2. Once the e-Gift has been redeemed, customers will have 24 hours to visit a participating M&S store and spend it. After the 24-hour period has ended, the e-Gift link will expire and customers will no longer be able to claim it.
  4. Offer: The voucher can be used to redeem a free sandwich from M&S to the value of £3.00. The recipient can purchase a sandwich that costs more than £3.00 by paying the difference. You can check the M&S store finder to find your nearest M&S café: www.marksandspencer.com

  • One claim per person.
  • The Promoter and the Administrator accepts no responsibility for any claims that are incomplete, illegible, corrupted, lost, damaged, delayed or fail to reach the Administrator within the specified SLA highlighted in the journey above (please see term 3).
  • The Promoter and the Administrator reserve the right to investigate and undertake all such action, as is reasonable, to protect itself against fraudulent or invalid claims including, without limitation, to require purchasers to provide further verification as to proof of purchase. In addition, the Promoter and the Administrator reserve the right to reject those claims which it considers, in its absolute discretion, are fraudulent or invalid.
  • Your claim will be deemed invalid if (including but not limited to) you;
    1. Are not a valid Vodafone customer;
    2. Have not been provided a promotional link by Vodafone to claim. This will have been sent via SMS
    3. Have failed in any way to otherwise comply with these Terms and Conditions as determined by The Promoter or the Administrator in its sole discretion.
  • The Promoter and the Administrator reserves the right to replace the offer with one of equal or greater value in the event of unavailability due to circumstances beyond its control.
  • The Promoter and the Administrator reserve the right to vary the terms of the offer at any time.
  • The e-Gift is non-transferable and no cash alternative is offered. This Offer cannot be used in conjunction with any other offers.
  • Insofar as permitted by law, neither the Promoter nor the Administrator, nor its associated companies, will be responsible or liable to compensate the customer, or accept any liability, for any costs associated with accepting the reward.
  • By redeeming the Offer you accept these terms. The Promoter's decision is final and correspondence will not be entered into. The Promoter’s privacy policy is available at www.vodafone.co.uk/privacy.
  • This campaign is administered by TLC Marketing UK Ltd (TLC), PO Box 468, Swansea SA1 1RH.   • The Promoter and the Administrator’s decision regarding any aspect of the Offer is final and binding. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation.
  • The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the gift, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  • If any of these terms or conditions should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
  • These terms and conditions shall be exclusively governed by the laws of England and Wales and customers irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
