Samsung Galaxy Buds 2 Promotion (5 April to 25 April 2023)

Participants agree to be bound by the following terms and conditions (the "Terms and Conditions").

The Promoter

1. The Promoter is Vodafone Limited (company number 01471587), Vodafone House, The Connection, Newbury, Berkshire, RG14 2FN (the 'Promoter')

Promotion Period

2. The Promotion will commence at 00:01 (GMT) on 5 April 2023 and run until 22:00 (GMT) on 25 April 2023 (the "Promotion Period").

Eligibility

3. To be eligible to participate in the Promotion you must be an individual that is resident (aged 18 or over) in the United Kingdom, Channel Island or Isle of Man, acting in your personal capacity ("Participant").

4. Network providers, retailers, distributors, resellers and any person who purchases a Promotional Product (defined below) for resale or otherwise not as the user of the Promotional Product, may not participate in this Promotion and are specifically excluded as a Participant.

Promotion

5. To participate in this Promotion you (hereinafter "you" or the "Participant") need to purchase a Samsung Galaxy A54 (a "Qualifying Device") from Vodafone's direct sales channels which include any Vodafone store, online via www.vodafone.co.uk or through Vodafone telesales during the Promotion Period.

6. Having purchased a Qualifying Device during the Promotion Period, you will be entitled to claim Samsung Galaxy Buds 2 - graphite colour ("Promotional Product") in accordance with these terms and conditions.

Claim Period

7. To redeem and claim your Promotional Product, you need to go to our partner website Get Go Fone (operated by Kid-A, acting on behalf of Vodafone Limited) getgofone.co.uk/collections/redemption within 60 days after the end of the Promotion Period, 24 June 2023 (‘Claim Period').

Claims

8. Within 7 days following the 14 day cooling-off period for your order as a whole (which includes your Qualifying Device), Participants will receive an SMS from Vodafone with a unique promotional code to claim your Promotional Product.

9. For the avoidance of doubt, if you return your Qualifying Device because of a change of mind during the 14 day cooling-off period, your Claim will be invalidated, and you will not be entitled to claim or receive the Promotional Product under this Offer.

10. Participants must visit Get Go Phone's website at getgofone.co.uk/collections/redemption and enter your unique promotional code, along with your name, contact details and address for delivery (a "Claim").

11. The Promotional Product will be sent to the delivery address provided as part of your Claim on the website. The Promotional Product will be dispatched once your Claim has been verified and will arrive by tracked delivery.

12. You are only eligible to claim one Promotional Product per Qualifying Device.

13. If purchasing online or over the phone, these terms and conditions and details of how to claim your Promotional Product will also be sent to you via email/SMS.

14. If there are any discrepancies between the purchase information and information provided by you in your Claim, a member of the customer service team will contact you within 30 days of your Claim being submitted online, and they may ask for proof of purchase to be provided (for in store purchases this will be in the form of an original itemised till receipt or order confirmation showing purchase of the Qualifying Device and dated within the Promotion Period; for online orders this will be in the form of an email receipt.)

15. If you are required to provide proof of purchase it is acceptable to provide a photocopy.

17. Any queries regarding the receipt of the unique voucher code please contact Vodafone customer care by dialling 191 from your Vodafone mobile while you're in the UK or 0333 304 0191 from a landline or other mobile (standard charges apply).

18. Owing to circumstances outside the reasonable control of the Promoter, and only where circumstances make this unavoidable, the Promoter reserves the right to withdraw or amend the Offer at any time but will use all endeavours to minimise the effect to the consumer in order to avoid disappointment.

19. The Promotional Product can't be exchanged and there is no cash or other Promotional Product available. Except owing to circumstances outside the reasonable control of the Promoter, the Promoter reserves the right to substitute the Promotional Product for a suitable alternative of equal or greater value.

20. You are responsible for any costs or expenses incurred as a result of participation in the Promotion including without limitation the purchase of a Qualifying Device and costs for claiming the Promotional Product including accessing the internet if applicable. Costs to participate in the Promotion via the internet may vary so please check with your local service provider for current charges. For the avoidance of doubt, delivery fees do not apply to the Promotional Product (subject to the eligibility criteria set out in these terms).

21. The Promotional Product is supplied with a warranty from the manufacturer. It is your responsibility to contact the manufacturer or visit the manufacturer's website in order to register your Promotional Product for the full manufacturer's warranty. No other warranty is provided.

Privacy and Data Protection

22. The Promoter's use of any personal information submitted by the Participant shall be limited to communications about the Promotion and for managing Claims and Promotional Product redemption processes. The Participant hereby consents to its personal information being used for this purpose and confirms that it agrees with the Promoter's privacy policy available at: www.vodafone.co.uk/privacy. The Participant may withdraw consent to such use of personal information by writing to the Promoter or by using the opt-out process outlined in the Promoter's privacy policy.

23. The details and information provided by the Participant when entering the Promotion or claiming the Promotional Product may be passed to third parties in connection with the processing of their Claim but will not be used for any other purpose other than as set out in these Terms and Conditions, unless you specifically consent to share your data for additional purposes.

General

24. The Promoter shall not be liable for any interruption to the Promotion whether due to force majeure or other factors beyond the Promoter's control.

25. The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary the Terms and Conditions of the Promotion.

26. The Promoter will not be responsible or liable for:

  • a) any failure to receive Claims due to transmission failures and other conditions beyond its reasonable control;
  • b) any late, lost, misrouted, or damaged transmissions or Claims;
  • c) any computer or communications related malfunctions or failures;
  • d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or
  • e) any printing or typographical errors in any materials associated with the Promotion.

27. By entering the Promotion, the participant agrees to release the Promoter from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind (including but not limited to negligence) arising out of or in connection with the Promotion or with the acceptance, possession, attendance at or use of any prize (except death or personal injury caused by the Promoter's negligence, for fraud, or otherwise as prohibited by law).

28. The Terms and Conditions for this Promotion are governed by English law and any disputes (whether contractual or non-contractual) arising out of or in connection with this Promotion shall be subject to the non-exclusive jurisdiction of the English courts.
